Building in grassland – notification to the Authority for Nature Conservancy

In green areas outside of built-up areas and on green areas with a star signature, the new construction, extension or conversion of buildings as well as the erection of supporting walls and free-standing walls (over 1.5m high) has to be notified to the conservation authorities or the locally-responsible municipality.

Form and contents of the notification: indication of the type, scope and location of the project, plans or equivalent graphic presentation (2 copies), depiction of the respective interests, declaration of consents of a different land owner.

The project can be rejected by the authorities within eight weeks of the complete notification, if the project conflicts with the interests of the protection of nature and countryside or a notice of assessment whereby certain restrictions, conditions or deadlines have to be met. The execution of this project can only be started if the project is not rejected within the eight-week deadline.

Confirmation of the non-rejection of the proposed plan can be provided upon the request of the party submitting the notification.

Exceptions: for projects which require construction approval, in the event of positive participation by the nature protection authorities in the construction approval process.
