Operational building – New, additional or re-construction

General information

In , specific building projects do not require a construction permit, but only a notification to the building authority. The advantage on the construction permit procedure is that though in the notification procedure - at least for buildings - a blueprint with all necessary descriptions (written by an authorized plan editor) has to be submitted to the building authority, for certain buildings and facilities no construction permit procedure has to be carried through.

Therefore - under certain conditions (in the absence of which a construction permit must be applied for) - the new, additional or modified construction of operational buildings - including those of agriculture and forestry - with a covered area up to 300 sqm and a building height of up to nine meters, in case of additional buildings however up to the height of the existing building, if the operational premises are not permanently used by humans or intended for animal husbandry, has to be notified to the building authority prior to the start of the construction activity.

Requirements

In order to obtain a favorable settlement of the building authority, the following requirements must be met:

·          The building notification must be consistent with the law and all legally required documents must be enclosed

·          The building project must not contradict the mandatory provisions of a land use plan, a land development plan, a statement to the new planning area or a legally binding building site permit
Waiver of objections by the neighbors

·          Confirmations of plan editor and site manager

·          The required consent of the land owner must be on hand

·          The building project must neither increase the risk of a severe accident in terms of human health because of its proximity to an existing operational plant in the sense of the Seveso II Directive, nor aggravate the consequences of such an accident in terms of human health

·          The building project must not contradict the mandatory building code

If the execution of the building project is not prohibited within eight weeks from the reception of the complete building notification duly equipped with all necessary enclosures, or if the building authority informs the notifier beforehand in written form, that a prohibition of the construction work is not intended, the construction work may be started.
