Such qualification certificate is to be issued by the authority following a written registration of operations within eight weeks of submission of all written proof that is required (§ 57e Oö. Tourismusgesetz 2018), provided that the applicant meets the general requirements as set out in § 57c Oö. Tourismusgesetz 2018 and provided that the applicant has the necessary professional qualifications in terms of § 57d Oö. Tourismusgesetz 2018. The application has to include the exact designation of the intended activity and the location envisaged for exercising that activity.
In accordance with § 57c Oö. Tourismusgesetz 2018, the qualification certificate for giving skiing lessons may only be issued to a natural person who
- is at least 18 years of age,
- is sufficiently reliable,
- is in a physical condition suitable for the activity and
- provides proof of a sufficient liability insurance.
The qualification certificate for giving skiing lessons is granted for a particular Location.
Persons who were issued with a qualification certificate are obliged to comply with the general regulations for carrying out their activity in terms of § 57f Oö. Tourismusgesetz 2018.
Only people who were issued with a qualification certificate to give skiing lessons may utilise the designation “skiing school”. Persons who were issued with a qualification certificate are obliged to manage the skiing school in person or to transfer management to a suitable deputy who holds a qualification certificate in terms of § 57b Oö. Tourismusgesetz 2018.
If operation of a skiing school in the envisaged municipality is not just temporary, but permanent for an unlimited period of time (domiciled skiing school), the person to whom the qualification certificate was issued is obliged to
- teach skiing in accordance with the principles of skiing instruction methodology and techniques approved by the Association of Skiing Instructors of Upper Austria;
- operate a clearly marked skiing school office and a clearly marked, safe meeting place suitable for allocating the skiing students into skill-based groups in the municipality where the skiing school is located for the entire duration of the operation obligation (§ 57g Oö. Tourismusgesetz 2018)
In accordance with § 57g Oö. Tourismusgesetz 2018, every domiciled skiing school has, if the snow levels so allow, to offer its services publicly and for all winter sports tourists in their municipality between Christmas and the week after Easter.
The Oö. Tourismusgesetz 2018 contains a list of reasons for termination which will result in expiry of the qualification certificate. This certificate, however, may also expire following a waiver. The waiver enters into effect upon receipt of the written waiver by the provincial government. The qualification certificate has to be attached to the waiver
