The management of a private agricultural and forestry school must be disclosed to the school authorities by the school board at least three months before the planned opening of the school with evidence of fulfilling the following legal requirements:
- the school board must be authorised to manage a private school (sec. 85 of the Upper Austrian Agricultural and Forestry Education Law)
- if a school board does not meet the conditions listed below, a director should be appointed for the pedagogical and administrative management of the private school, who
- is an Austrian citizen or equal according to the legal regulations,
- shows an aptitude to teach in terms of morality and health,
- has proof of a teaching qualification for the persons concerned or a related type of school or a special suitable qualification, and
- whose circumstances would not have a negative impact on the Austrian school System.
The teachers employed at the school must also meet the conditions listed under numbers 1 to 4.
The school authorities can show lenience for the requirement of no. 1, if this is in the interest of the school and does not oppose the public interests of the granting of lenience.
The financial, personal and spatial provision for the management of the private school behoves the school board. In particular, the school board must have the necessary teaching materials and other equipment and facilities for classrooms, which comply with the purpose and the organisation of the private school and with the pedagogical and hygienic principles in terms of construction and facilities, and for the implementation of a curriculum.
After receiving the regularly drafted disclosure, the school authorities verify that the legal regulations for the management of an agricultural and forestry school have been met. If the legal requirements for the management of an agricultural and forestry school is not available, the school authorities must deny the management of the private school within two months from receiving the disclosure. Should the management of the private agricultural and forestry school not be denied by this deadline, the school can be opened.
Along with the disclosure of the management of the private school, the school board must disclose the planned name of the private school to the school authorities.
The following changes must promptly be disclosed to the school authorities:
- every change in the organisation of the private School
- the adjustment of the school management and the conveyance of the School
- the appointment of the director and of the teachers
- the resignation of the director from his/her function as director
- the resignation of the teachers from their teaching functions
- the circumstance in which the director or a teacher no longer meets the conditions listed above under no. 1 to 4, without having been granted the respective lenience (sec. 86 par. 4 of the Upper Austrian Agricultural and Forestry Education Law)
- every change in the name of the private School
- the further management of the private school until the end of the current school year by the estate or after the end of the probate proceedings by the heirs of the school board.
